What if I don’t know where my spouse is living, but I need to have him/her served?
Service may be effected on a spouse whose location is unknown through an order of publication. The party seeking service must file a sworn affidavit stating that due diligence has been used, without success, to ascertain the location of the party to be served. The affidavit must state either the last known address of the Defendant, or state that the address is unknown. After the affidavit has been filed, an order of publication must be drafted and signed. The order of publication requires Defendant to appear and protect his or her interests on or before the date stated in the order. The order must be published once a week for 4 successive weeks in a newspaper designated by the Court, and must be posted at the front door of the courthouse. A copy of the order must be mailed to the last known address of the missing spouse, if any.
