My spouse informed me of his/her adultery, but then we resumed marital relations. Can I still maintain a suit for divorce on the ground of adultery?

No. Under VA Code § 20-94, a divorce will not be granted if it appears that the parties voluntarily cohabited after knowledge of the adultery. A divorce on the grounds of adultery will also not be granted if the adultery occurred more than 5 years before the suit was instituted, or if the adultery was committed by procurement or connivance of the party alleging the adultery.
